Terms and Conditions (T&Cs) for Clients in Saudi Arabia

These Terms and Conditions ("T&Cs") apply to all services provided by Stoned Tailor, operating under the brand X-360 ("we", "us", "our"), in partnership with Modern Dimension Energy Company ("partnered company"). By engaging our services, the client agrees to these T&Cs.

Services Provided:

X-360 offers comprehensive 360 virtual tour services, including but not limited to the creation of virtual tours, hosting services, and additional features like interactive elements and custom branding. The scope of work will be detailed in the Work Order Sheet

Payment:

All services are priced as per the rates specified in the Work Order Sheet. A payment schedule will be provided, typically requiring a deposit upon signing the Work Order Sheet and the remaining balance upon completion of the services. Accepted payment methods include credit card, bank transfer, and other methods as agreed upon. Late payments may incur additional fees.

Delivery and Review:

X-360 will deliver the virtual tour and any other agreed-upon deliverables by the timeline specified in the PO. Clients will have an opportunity to review and approve the deliverables. Any feedback or required adjustments should be communicated promptly.

Client Responsibilities:

The client must provide all necessary information, resources, and access to properties as required for the creation of the virtual tour by the deadline agreed upon in the PO to avoid delays.

Changes and Revisions:

Any changes or revisions to the project scope must be requested in writing. X-360 will assess the changes and inform the client of any additional charges and revised timelines.

​

Cancellation and Refunds:

Clients may cancel the services by providing written notice. No refunds will be provided for work already performed.

Intellectual Property: X-360 retains ownership of all intellectual property rights related to the virtual tour until full payment is received. Upon full payment, the client receives the rights to use the virtual tour for their intended purposes. X-360 reserves the right to use the virtual tour for marketing and promotional purposes unless otherwise agreed.

Confidentiality:

X-360 agrees to keep all client information confidential and will not disclose any such information without the client’s consent, except as required by law.

Warranties and Limitations:

X-360 warrants that the services provided will be of professional quality. However, X-360 disclaims any warranties regarding uninterrupted service or error-free content. X-360’s liability for any claims arising from the services provided is limited to the amount paid by the client for those services. X-360 is not liable for indirect, incidental, or consequential damages.

Partnership with Modern Dimension Energy Company:

Modern Dimension Energy Company is a partnered company with X-360 to execute services in Saudi Arabia.

Jurisdiction and Dispute Resolution:

These T&Cs are governed by the laws of the Kingdom of Saudi Arabia and India. Any disputes will be resolved through mediation or arbitration as agreed upon by both parties. Force Majeure:

X-360 is not liable for any failure to perform services due to events beyond its control, such as natural disasters, pandemics, or other unforeseen circumstances.

Amendments:

These T&Cs may be changed without any prior notice or any notice. Any amendments or modifications to these T&Cs must be made in writing and signed by both parties.

​

Entire Agreement:

These T&Cs, along with theWork Order Sheet, constitute the entire agreement between the client and X-360, superseding any prior agreements or understandings.

​

Severability:

If any part of these T&Cs is found to be unenforceable, the remaining parts will continue to be in effect.

Notices: All notices required under these T&Cs must be provided in writing and sent to the respective parties via email or mail as specified in the Work Order Sheet.

Acceptance:

The client’s signature on the Work Order Sheet or acknowledgment of these T&Cs constitutes acceptance of these terms.

The terms and conditions are only applicable to clients in the Kingdom of Saudi Arabia and GCC countries. For any projects completed in different countries, the terms will be provided by the advisor upon project completion
